CONFLICT IN THE WORKPLACE

Workplace conflict is an occupational safety and health hazard that requires responsible action by employers. A 1998 U.S. Justice Department study found that each year there are about 2 million violent incidents at work, including 1,000 homicides, 600,000 assaults, 42,000 rapes and sexual assaults and 23,000 robberies. In addition, lower level forms of violence include: bullying, verbal abuse and harassment. The Society for Human Resource Management found that half the companies in the U.S. have experienced workplace violence and 41% of employees have experienced verbal threats at work.

Consequently, most states have implemented labor codes, similar to California, that require employers to provide a safe and healthful place of employment. In 1998, the U.S. Supreme Court determined that companies must prevent – not simply react to – a hostile workplace. Under OSHA regulations companies have a general duty to furnish each employee a working environment “free of hazards that are causing, or likely to cause death or serious harm to the employee,” and employers are liable for actions of the employee when the employee is working, even if the employee is not acting within company policy.” However, the American Society of Safety Engineers’ (ASSE) found that many companies and organizations in all industries have yet to address the problem of workplace violence. Moreover, it is estimated that when an employee takes their employer to court the average cost is $700,000. Some estimates place the annual cost of workplace violence as costing companies 36 billion dollars a year in absenteeism, employee turnover and loss of productivity.
